Dealing with bad product from China

For anyone who sources regularly from China, you know all too well the difficulties of trying to reject or rework bad product from one of your Chinese suppliers or factories. China Law Blog links to Silk Road International Blog where they outline some of the common excuses Chinese factories give for producing bad product. I’m not in a sourcing or merchandising position within my company but close enough to be copied in on the occasional product snafu, and I recognize some of these excuses. Read the whole thing.

China Law Blog follows up their link to Silk Road International with some excellent advice on how to deal with quality control issues from China when they occur. Bottom line:

You want something from your Chinese manufacturer, you put it in your written contract. You are also usually better off with your contract being in Chinese so that if there is a dispute, your Chinese counterpart is not well positioned to claim it failed to understand and if you do need to go to court in China, you have the contract ready to go for that purpose.
